Terms and Conditions of the „Be Arval’s Safe Driving Ambassador” competition

§ 1 General provisions

  1. Terms and Conditions define the conditions of participation and the rules of the „Be Arval’s Safe Driving Ambassador” Competition (hereinafter referred to as „Terms and Conditions”, „Competition”) on the ambasador-arval.pl platform The organizer of the Competition is Arval Service Lease Polska Sp. z o.o. with its registered office in Warsaw (020675) at ul. Wołowska 24, which is entered into the Register of Entrepreneurs kept by the District Court for the Capital City of Warsaw, XIII Commercial Division of the National Court Register under the KRS number 0000029819, with share capital of 11 500 000.00 PLN, statistical number REGON 016096737 and tax identification number (NIP) 5213033865, hereinafter referred to as the “Organizer”. The Competition Partner is Greenval Insurance DAC with its registered office in Dublin, Ireland Trinity Point Leinster Street South 10011, 000002 Dublin, registered under number 432783. The Competition Partner is Kia Polska Sp. z o.o. with its registered office in Warsaw at ul. Puławska 366, 02-819 Warsaw, which is entered into the Register of Entrepreneurs kept by the District Court for the Capital City of Warsaw, under the KRS number 0000018778, with share capital of 15 700 000 PLN, statistical number REGON 012710235, using tax identification number (NIP) 5261910258, BDO: 000027097.
  2. Participation in the Competition will be considered as acceptance of the Terms and Conditions and the obligation to comply with its provisions.
  3. Participation in the Competition is voluntary and free of any charge.

§ 2 Competition participants

  1. Any user of the Organizer’s vehicle, using it based on an authorization received from Organizer’s Client (hereinafter referred to as “User”) can be a participant in the Competition. Organizator’s Client means any entity with which the Organizer concluded a vehicle rental agreement. The Organizer reserves the right to select the Clients who will be invited to participate in the Competition.
  2. To participate in the Competition User have to create an account on the website www.ambasador-arval.pl.
  3. Before participating in the Competition User should report any damages to the car that happened before the start of the Competition.
  4. By entering the Competition on the ambassador-arval.pl platform, the User consents to the processing and sharing of personal data in accordance with the Act from August 29, 1997 on the protection of personal data (Dz. U. [Journal of Laws] of 2022, as amended) and the information clause on the ambassador-arval.pl platform. Providing personal data is mandatory to participate in the Competition. User’s personal data, obtained during the Competition, will be processed only regarding the organization of the Competition, rewarding and delivering prizes, and the payment of income tax on prizes.

§ 3 The aim of the Competition

  1. The aim of the Competition is to promote safe driving and reduce the number of road accidents involving cars used by the User During the Competition, the User should collect as many points as possible, rewarded for damage-free driving, and participate in activities promoting safe driving on the ambassador-arval.pl platform.

  3. The condition for receiving the prize is driving the vehicle in accordance with the law, responsibly and with adequate caution, resulting in improved safety and reduced number of car incidents on a road, as well as reducing the number of road accidents resulting in damage to the User’s car and/or other object and/or person.
  4. During the competition, each of the Users will be verified in terms of whether there have been any road incidents involving cars used by the User during the 6 months of safe driving period.
  5. User’s safe driving will be verified by checking the incidents registered in the Organizer’s operating system.
  6. The competition is about collecting points for individual activities within the competition platform. User with the most points collected wins
  7. If several Users achieve the highest number of points, the prize will be given to the User with the best average result of all quizzes from all months or the best average time of all quizzes from all months.
  8. Competition participants can collect points in the following activities:
    1. Quiz
      1. The quiz is added only once a month, if you have already taken it, wait for the next quiz. During the 5 months of the game, there will be 5 quizzes available.
      2. Of all activities the quizzes are worth the highest number of points, 1 quiz is 1000 points.
      3. Each quiz question has a score. The questions can be multiple choice. Points are counted from the answers, not as a percentage. If there are 10 tasks in the quiz, please set 100 points for the correct answer, correct answer for 9 tasks will give 900 points, 8 tasks will give 800 points and so on.
      4. Quiz time is recorded after the user completes the quiz. The time spent on the quiz (in seconds) affects the ranking, but not the overall score. 2 participants who scored 1000 points for the same quiz, but solved it at different times will
        appear in ranking in order from the one who solved it the fastest.
      5. Users with the same number of points from other competitions are below in the ranking of people who took part in the quiz.
      6. The quiz can only be taken once. The quiz cannot be interrupted.
    2. Film
      1. Activities: Videos are added twice a month, if you have already used them, wait for the next one. During the 5 months of the game there will be 10 videos available
      2. Each video is worth 200 points.
      3. You can watch a video multiple times, but points per video can be collected only once.
      4. The video has navigation turned off and the sound is muted to 50%
    3. Board game
      1. There are 36 difficulty levels in the game, and each difficulty level is the number of steps necessary to complete the goal, i.e. driving the car out of the parking lot. In the simplest levels, 3–5 moves are needed, in more difficult levels, 15–20. The User gets 10 points for each move, as long as they are in the maximum number of moves per level. However, if User makes many more, exceeding the maximum number of moves, points will start to be deducted for each extra move. User can only improve score, playing a specific level of the game again will not result in doubling the points for the level.
      2. Max. Points/Level = Min. number of moves to solve the level. 1 move = 10 points.
    4. Safe driving is worth the highest number of points. Verification of safe driving takes place at the end of the competition. 1 month of safe driving is worth 1000 points. Users can get a bonus for 6 months of completely safe driving, worth 3000 points added after the end of the Competition.
  9. The results of the Competition will be sent to the Users electronically within 7 days of announcing them on the ambassador-arval.pl portal.
  10. The User has the right to submit a complaint within 14 days from the date of receiving information about the prize. The complaint should be submitted by e-mail to: arval@arval.pl.

§ 4 Prizes

  1. Information about the Competition results will be displayed on the platform for logged Users in the form of a Users’ ranking list. The final results will be displayed after the verification of Users safe driving.
  2. Competition prizes will be given to the three Users with the highest number of collected points.
  3. The prizes consist of:
    (1) Main prize: travel agency voucher worth 10 000 PLN for use within 12 months from the issue date
    (2) Second and third prize: travel agency voucher worth 3 000 PLN for use within 12 months from the issue date
    (3) Every month, starting from January 2022 and ending in June 2023, an additional prize will be given to the User, who collected the most points in a month. If several Users achieve the highest number of points, the prize will be given to the User who has the best quiz score achieved in the fastest time. As a monthly prize User can use free of charge a KIA e-Niro electric car for one weekend, i.e. from Friday to Monday. The car will be fully charged and User will additionally get a voucher for 50 kWh for use in the Greenway charging network. The dates of using the car will be consulted individually with the winner, however, they cannot be beyond the date of results announcement on August 31, 2023. The car has to be returned to the headquarters of Kia Polska Sp. z o.o. at ul. Puławska 366, Warsaw.
  4. Prizes cannot be exchanged for cash or other prizes
  5. Users cannot transfer the right to receive the prize to third parties.
  6. User who has been rewarded with the prize has the right to waive the prize by submitting a, adequate statement to the Organizer.
  7. Regardless of the other Terms and Conditions provisions, the User loses the right to the prize if the provided personal data turns out to be incorrect or untrue, which would prevent from handing over the prize or if it turns out that during the Competition the car was involved in an accident resulting in damage to the User’s car and/or other object and/or person. This restriction does not apply to monthly prizes.
  8. The prize winners are obliged to answer within 14 (fourteen) days from the date of receiving the information whether they accept the prize.
  9. The prize will be given to the User in the form agreed with the Organizer.
  10. For the main prizes mentioned in points 3.1. and 3.2., an additional cash prize will be given by the Organizer, with the expect that this amount is not given to the Users, but will be used to cover the tax on prizes in the Competition.
  11. Prizes mentioned in point 3. and additional prize mentioned in point 10. are income from winning in the Competition and are under 10% flat-rate tax on the terms set out in the Personal Income Tax Act.
  12. The winner is obliged to send the Organizer the data necessary to prepare a tax return (name, surname, registered address, ID card number and series, PESEL number) within 14 days from the date of information about winning.
  13. The Competition is not a gambling game within the meaning of the Act from November 19, 2009 on gambling games (Dz. U. [Journal of Laws] No. 201, item 1540, as amended).

§ 5 Duration of the Contest

  1. The Competition will take place from January 9, 2023 until August 31, 2023 (6 months). Competition activities will close on June 30, 2023
  2. From June 30, 2023 by August 31, 2023 (60 days) the database of road incidents will be verified, where a negative verification will exclude the User from the Competition and prevent from getting the prize.
  3. The end of the Competition and the announcement of the winners will take place on August 31, 2023.

§ 6 Final provisions

  1. The Competition Terms and Conditions are available at the ambassador-arval.pl platform and at the Organizer’s office.
  2. The Terms and Conditions come into force on January 9, 2023 and remain in force until the and of the Competition. The Organizer reserves the right to change the Terms and Conditions for important reasons, independent of the Organizer, with the exception that changes to the Terms and Conditions will not violate the rights acquired by the Users. Information about changes to the Terms and Conditions will be sent to the Users via e-mail.
  3. Users are obliged to comply with the following rules:
    a. Not to use the prizes for unlawful purposes or for purposes not provided for by the Organizer, including commercial and political purposes;
    b. Not to send unlawful, offensive content, etc. to the Organizer.
  4. At any time during the Competition the Organizer has the right to exclude a User from participating in the Competition (including refusing to give a prize) in relation to whom the Organizer has a reasonable suspicion of acting contrary to the Terms and Conditions.
  5. All information about the Competition available in advertising and promotional materials is for information purposes only. Only the provisions of the Terms and Conditions have binding legal force..
